This article examines the growing trend of remote work and the challenges it
poses for labor law regulation. With technological advances and the transformation of work relations, aspects such as the workplace, workplace safety, workers' rights and
control over work take on new dimensions. Remote work is on the rise, driven by
technological advances, changes in worker modifications, and responses to the COVID19 pandemic. Regulatory challenges include specific issues such as the difficulty of
tracking hours worked, cybersecurity concerns, and the need to ensure workers' rights.
The definition of the workplace is evolving, affecting workplace safety, ergonomics and
the mental health of workers. Workers' rights, such as overtime, sick leave and protection
against discrimination, are also impacted by remote work, or require adaptation of labor
laws. Furthermore, the article highlights the challenge of worker control in remote
environments, balancing worker autonomy with employer supervision. Further
emphasizing the need for legislative reforms to effectively accommodate remote work
and ensure adequate protection of workers' rights in a constantly evolving work
environment. Adapting labor regulations becomes crucial to maintaining job security and
equity as traditional forms of work give way to new dynamics driven by technology and
social change.
