This study examines the recycling and sustainability scenario in Brazil, highlighting advances and challenges following the implementation of the National Solid Waste Policy (PNRS) in 2010. Despite improvements in waste management, low recycling rates, the devaluation of recycled materials, and the lack of fiscal incentives remain significant obstacles. The research is based on a literature review to explore the role of Environmental Law in regulating the preservation and sustainable use of natural resources. The recycling crisis mainly affects waste pickers, responsible for 90% of the recycled volume but facing precarious working conditions and low pay. Technological innovations, such as artificial intelligence, are identified as potential solutions to optimize the recycling process. The study also proposes new regulations, including fiscal and tax incentives, to promote a circular economy and enhance environmental practices. In conclusion, more effective public policies are needed to encourage industry and raise public awareness about the importance of recycling, aiming for a more environmentally and economically sustainable future.
