ATUAL ENTENDIMENTO DO SUPREMO TRIBUNAL FEDERAL ACERCA DA EXECUÇÃO PROVISÓRIA DA PENA.

Abstract

This article has a its theme the provisional execution of the sentence, the
objective is to address whether it would be possible to execute the sentence before the
final judgment of the condemnatory criminal sentence, and if this possibility would
confront the principle of the presumption of innocence expressed in the Constitutional
text. Over the years, the Federal Supreme Court has positioned itself on the subject, at
times understanding the legality of provisional execution, and at others not. The work will
address all these moments of understanding of the Supreme Court on the subject. A
bibliographic and judgment research was carried out to obtain the result of the research.
