O IMPACTO DAS PATENTES NO PROCESSO DE INOVAÇÃO: PROTEÇÃO VERSUS EMPECILHO

Abstract

This article explores how patents can function both as a barrier to technological
development and as a protection tool in the innovation process. By analyzing the duality of
patents, this study seeks to shed light on the complexity of the legal and economic
implications of patents in different sectors. Through a literature review and factual analysis,
it was discovered that the patent system, when not used properly, encouraged innovation and
the sharing of codifiable knowledge, harming the development of developing nations.
